All intellectual property rights in the Software, documentation, and related materials remain with Dess. No ownership rights are transferred to the Client under this Agreement.
3.5 Limitation of Liability
Dess is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the Software.
3.6 Termination
Dess may suspend or terminate access to the Software if the Client violates this Agreement.
Upon termination, all licenses are revoked and data will be handled according to the Client’s instructions.
3.7 Governing Law
This Agreement is governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts at Texas, USA.
